Right to Freedom
As per Article 19 (1) of the Constitution of Indian is reproduced as under:
All citizens shall have the right-
(a) to freedom of speech and expression.
(b) to assemble peaceably and without arms.
(c) to form associations or unions.
(d) to move freely throughout the territory of India.
(e) to reside and settle in any in any part of the territory of India.
(f) to acquire, hold and dispose of property and
(g) to practise any profession ,or to carry on any occupation, trade or business.
The “Constitution of India “and the “Fundamental Rights” there in prevails over the rules and regulations, byelaws etc. if any framed by the School Management in respect of obstructing and restraining the staff of the school from joining any Association/Union and even taking membership of such Association/Union then such rule/bye law etc. shall be avoid rules and illegal and invalid agreement, being contrary to the “Constitution of India”.
Therefore every citizen of our country which also includes the “CBSE Teacher” has a right to form the Association or union and to have a membership of such Association etc. as this is one of the “Fundamental Right” as mentioned in Article 19 (1) (c) of constitution of India.
