Hence huge number of existing CBSE schools with the demand of new CBSE schools at every nook and corner of our country is increasing day by day. Therefore the appointment of such a staff is an on-going process in today’s scenario being need of the hour.
But CBSE schools all over India neither follow the CBSE Affiliation Bye laws nor the rules of State Govt. where they are running their schools as mentioned in the CBSE Bye laws as well as even they do not follow the rules of Central Govt. Because every management of these CBSE schools frame their own so called rules as per their comfort and convenience without following the procedure of law which amounts to exploitation, humiliation, harassment of the CBSE staff which finally results into inhuman treatment to all the teaching as well as non-teaching staff working in the CBSE schools across the country.
Hence, constitution of School Tribunal for the entire staff of CBSE School throughout India as mentioned earlier is need of the hour, as there is no such school tribunal anywhere in any corner of India for redressal of grievances of teaching as well as Non-teaching staff working in various CBSE Schools.
So, for resolving the grievances and problems and to protect the rightful interest of CBSE School’s Teaching and non-teaching staff whether permanent, temporary or working on daily wages across the country as regards to their employment and service conditions and to act as their representative for this purpose in all judicial matters/cases and also to promote the general welfare of the members of the Association all over India, Adv. Sanjay Shridhar Kashikar being the Founder Member and Legal Adviser has established the Very First Association In India Under the Name and Style

“Constitution of School Tribunal for CBSE Teaching and Non- teaching Staff of CBSE Schools all over India.
- The Hon’ble High Court of Judicature at Bombay, Nagpur Bench at Nagpur in a writ petition no. 1987/94 dt. 22/07/2010 between the parties has observed and held that:
“Since all the CBSE schools are affiliated to CBSE, hence the School Tribunal constituted by the State Government has no jurisdiction.”
Also State School Tribunal has no right to deal any legal issue of CBSE staff and to give them justice hence CBSE schools teaching as well as Non-teaching staff have to approach the Civil Court for justice which consumes lot of time as various technical objections are always raised in the Civil Court regarding jurisdiction reliefs etc. and also the school managements finds its own ways through technical loop holes to escape by Hooke or Crooke for their personal profits.
- Hon’ble Minister Shri. Nitinji Gadkari in his letter dt. 08/09/2018, addressed to the Hon’ble Minister H.R.D. Shri. Prakashji Jawadekar after the meeting with the Members of the Executive Committee of C.S.S.W.A. along with the Founder Member and Legal Adviser of C.S.S.W.A. Adv. Shri Sanjay S. Kashikar, has expressed his feelings which are reproduced as under:
“In the view of above, I am of the opinion that the demand of CBSE School’s Staff Welfare Association seems to be genuine so that the cases from these schools can be dealt separately in the proposed tribunal, increase the speed of the verdicts, give justice to the teachers and also create a new platform for dealing of CBSE school legal matters.”
- The Hon’ble Minister H.R.D. Shri. Prakashji Jawadekar is also aware of the following one of the very essential fact that:
“At present there is no School Tribunal for CBSE Staff constituted by the Government for redressal of grievances of teaching as well as Non-teaching staff of CBSE schools, which they are facing every now and then and also is increasing day by day”.
- IN THE HON’BLE SUPREME COURT OF INDIA
Civil Appeal No. 6634 of 2012 (Arising out of SLP (C) No. 7232/2011)
Decided On: 13.09.2011 and held that:
“ the Appellate Tribunal should be set up in each district of each State to hear appeals over the decisions taken the Disciplinary Bodies of even purely private educational institutions. It was emphasised that speedy resolution of the disputes between the teachers and the management is in the interest of all, i.e. students, management as well as the concerned teachers.”
Hence, constitution of School Tribunal for the entire staff of CBSE School throughout India has become the need of the hour, as there is no such school tribunal anywhere in any corner of India for redressal of grievances of teaching as well as Non-teaching staff of CBSE Schools.
